There are fundamental differences between divorce under Islamic jurisprudence or Muslim laws and Jewish law. In Islam, there is no concept that a divorce is invalid if it is ‘against the will of the spouse’. Muslim jurisprudence and the laws of the overwhelming majority of Muslim contexts recognise numerous grounds for women to initiate divorce without the husband’s consent.
The analysis in this document asks why British Muslim women have far fewer rights to divorce than women in other Muslim countries.
